Non point source pollution from stormwater and stormwater runoff plays a large part in impairing NY’s waterbodies. Stormwater runoff from streets, parking lots and other urbanized areas carry with it any number of heavy metals, toxic compounds and excess nutrients. Construction activities are also highly likely to contribute to the degradation of our waterways.

The EPA Phase II Stormwater regulations were developed to deal with nonpoint source pollution from stormwater. One aspect of the regulations deal with MS4’s (Municipal Separate Storm Sewer System’s) exceeding a large, arbitrary population size. While Schuyler County contains no regulated MS4 communities, the District is working with other organizations in the county to address those very same issues being tackled by regulated communities—including education and outreach, reviewing local laws and ordinances and developing useful GIS layers to aid in planning.

The other aspect of the Phase II regulations requires all construction activities disturbing greater that 1 acre to develop a Stormwater Pollution Prevention Plan (SWPPP) and gain coverage under NYS DEC General Permit# 02-01. Construction activities include clearing vegetation, grubbing, filling, grading, demolition and soil disturbance. The District is available to help you understand the specifics of the Phase II program. Contact us immediately if you have any questions regarding these new regulations.

Also, the District is available to provide assistance (through an agreement with NYS DEC at no charge to the individual or organization making the request) for general compliance questions, assistance for filing a Notice of Intent and site plan and SWPPP reviews. Proper site planning well in advance of beginning construction will help make your project more successful and will help protect our local lakes and streams.
